It depends on what your policy says, but generally, yes, you are covered. Insurance covers your negligence. If you hit another car while DUI, your insurance will cover the property damage (and personal injury). If a person sues you and claims intentional or reckless behavior (those have specific legal definitions to them) that is not covered, generally, under your policy. If the person sues you and claims negligence, that is covered. An insurance company may deny coverage, they may defend but not indemnify (meaning hire a lawyer to help you but not pay any damages assessed in the end) or they may bring a declaratory action, meaning that ask a court to determine whether or not they have to pay. This is usually done in advance of or at the same time as the underlying lawsuit. This is not an area of the law that should be tackled by yourself. Get a lawyer who deals with insurance coverage issues, there are a lot of landmines in this aread of the law.
