Police Reports and Auto ClaimsAn Insurer may not deny your claim simply because no Police report is filed. The filing or non-filing of a police report should have no bearing on your Insurance Policies effect of coverage. In most jurisdictions of the U.S. these days police will not even come to the scene of an accident unless there are personal injuries or some type of dispute involved or when they are needed to handle traffic issues resulting from the accident. The police especially do not respond to the scene of accidents when the accident involves a single vehicle or when it occurs on private property.
Property related Accidents on Private property are not even under the jurisdiction of law enforcement anyway. It just makes no economic since to take an officer away from other duties to file an auto accident report when their is no dispute or injuries.
If your claim was denied for the sole reason of no police report having been filed, then I would consider that a frivolous denial. You should consider finding a more reputable Insurance Company.
The proper procedure is to submit a claim for the loss to your insurance companies claims department. If you feel your claim was denied unjustly and that your policy should cover then you may need to seek legal advice to enforce your rights under the policy.
Answerhow long has it been? how long did you wait to file the claim? any witnesses? does your policy have a ''no drunk driving'' endorsement?
