It depends. Was the driver the listed insured? If not, did he have regular access to the vehicle and/or operate it often? In this scenario it is highly unlikely they will accept the claim.
If the driver was the insured, they may or they may not. You should check your insurance policy but keep in mind any claim submitted involving DWI aka DUI if it has not already been submitted to the police will be brought to their attention for sure.
Here's the best part: If they do or don't pay the claim the policy will be terminated for sure as regardless if it was you or someone else they will consider a customer who allows anyone else to do this as an unacceptable risk, in most cases.
