The incarcerated person needs to havesomeone who is either a spouse or holds power of attorney or legal representativefor them file their taxes. If there is no one in either category the prisoner will have a tax liability status until he or she is released and able to file.

Also note: most people in prison have very little income and as a result, they are not legally required to file an income tax return.
