My divorce decree forbids me to cohabitate with my new partner or the house will be sold can my boyfriend still sleep over night in the house?

* My lawyer told me the same thing in regard to my spouse support. He said move in with him and you're finished. * I would either discuss this with your divorce attorney, or find a new attorney. I know that in the state I live in, this cannot be a provision in the divorce agreement unless both partners agree to it. Having a boyfriend spend the night is not considered co-habitation, any more than having a relative come and stay with you is considered cohabitation. Spousal support is different issue. If you move in with another person, that is considered a common law marriage in most States and as such, you may lose your support.
