Is it legal for church members who do not tithe to vote on church matters?

That depends on the individual church charter and regulations of the denomination it belongs to. If the church in question has members of the congregation vote on church matters at all (not all do), then this is done however they've decided it should be done. There is no biblical description on how this must be handled that I know of.
