There are only two times when a claim value is determined. One is when the jury makes the award or the other is when you agree on an amount. There is absolutely no standard. Every claim and every person and every situation is different in every jurisdiction.

There are no standards. Each claim is different. The adjuster will look at prior medical history, current medical records (what your Dr writes about each visit), amount of bills, how much of those bills are just diagnostic tests. Where the injuries are, a sore elbow isn't worth as much as an injury to a weight bearing bone). If it was a vehicle accident - if any of the fault could be placed on you, the amount of damage to the vehicles and where that damage is. A lot of people think that running to an attorney will get them more money, but it usually doesn't.
