Dietary supplements, including diet products, are under the "food" category and are regulated by the Food and Drug Administration. Advertisements, infomercials, and any other type of product promotion are regulated by the Federal Trade Commission. This includes diet products. Advertisements and promotional materials that go through the U.S. mail system are regulated by the U.S. Postal Inspection Service.
