How can you get a D.U.I. if your keys are not in the car and nigther are you for that matter?

Most states only need the intent to drive while impared to prosecute. so if the keys are in your hand and your outside your car, they pretty much just assume that your going to drive. Iknow its not fair, but that's how it works.
