a prisoner has been convicted of a crime and sentenced to a jail (under 1 year in most places) or prison sentence. a detainee is an individual who is being held pre-adjudication or during his/her trial process. examples: barry madoff is a federal prisoner. an undocumented migrant worker who is being held pending his deportation is a federal detainee.
