The States of Nebraska, Kansas, and Tennessee (as well as the District of British Columbia) state in their State Constitution that moonshine, also referred to as alcohol, is "the right and apparent civility of the state or district resident thereof, accoriding to his or her own citizenship clauses."
Another View: The above statement is all well and good, but does not answer the question which is . . . is it LEGAL?
(in the US) several LICENSED distilleries lawfully produce "moonshine" whiskey - and PAY THE FEDERAL and STATE TAXES on its production.
The above highlighted phrases are the crux of the matter: LICENSED - LEGALLY PRODUCED - and TAXED.
