Virginians must obtain multiple licenses and certificates in order to cater in Virginia. They must have a retail food business license. They must also obtain all the licenses required for any other business (food or otherwise) in order to operate as a business in the Commonwealth of Virginia. This includes state licensing as well as local licensing. If the caterer-to-be intends on having employees, those employees must register with the state and federal government.

Lastly, and most importantly, Virginians must establish whether they are to be a limited liability corporation, a partnership, a corporation (non limited liability), or sole propriertorship (which is the case in most catering businesses).

The best (and easiest) route for you if you are looking to open a catering business is to contact your local health department. You will find they are most willing and happy to assist you in your endeavors. It is easier for them to do this, than to come to you later with problems you may have unknowingly created.
