The local government, just like the state and federal government get their authority from the people, who are the original holders of inherent political power. All power or authority bestowed upon government officials flows from the people, and that authority remains limited in its scope and term and can be taken away by the people at any time.
The current state of affairs, where the local, state and federal government has so intruded upon the everyday personal lives of the people is actually the best evidence to support the assertion that it is self evident that all government power flows from the people.
In the State of California, and I suspect it is the same for most if not all States, the Department of Motor Vehicles boldly asserts over and over again that driving is a privilege and not a right. This assertion is false. If it is accepted that it is self evident that all people have the right to life, liberty and the pursuit of happiness, then driving is most certainly a right. If driving is a right then how is it that local, state and the federal government can get away with the declaration that it is not a right and only a privilege to be granted by the government?
Under our Constitutional form of government, it is not the responsibility of the government to keep the people from going into error, it is the responsibility of the people to keep the government from going into error. In the case of driver's license's instead of challenging this authority, we the people went into agreement with it, and the assertion that driving is a privilege and not a right remains uncontested, especially for those of you who have registered their cars with the DMV and requested a driver's license. This became a granting of jurisdiction to the administrative agency who had no Constitutional authority over you before you granted them that jurisdiction. This proves that all power flows from the people.
