Why would unwritten laws benefit the patricians?

Perhaps because they could take advantage of the absence of a formal law and start charging for whatever they want... the plebians have no protection from the law, so they would have an advantage if they wanted to start "renting" out farmland or lowering wages, knowing they could replace the workers.
