If a teacher is talking about a student to the class while the student is not in the classroom is that breaking a law?

Not Breaking a Law, but...Teachers talking about a student to the class while the student is out is not breaking any laws, but unless the teacher is saying something brief and good about the student, it is definitely in very poor taste and judgment.
