Who is at fault when you are forced off the road by another car which causes you to run into the guard rail but you didn't hit the other car and can the other driver be sued?

Your local laws may be different, but generally, if you didn't make contact, the driver of the other car cannot be held responsible. Check with laws from your state, but I believe that is pretty much a universal law.
