Most will say the Bill of Rights, and certain amendments; however the entire thing was actually proposed in the protection of uniform rights at a level appealable from the states. No single 'state' won the war, they all banded together; and quickly after that war they began to divide on lines that were seen as a re-institution of the abuses devices of government that they had just thrown off.
