What is a court remand?

A court remand is a legal process in which a higher court sends a case back to a lower court for further action or a new trial. This typically occurs when the higher court finds procedural errors, insufficient evidence, or other issues that warrant a reevaluation of the case. Remands can also happen prior to trial, where a defendant is sent back to custody while awaiting further hearings or decisions.
