Is 49cc legal to ride on public roads?

yes you can but you have to have a chauffeurs chauffeur's or operator's license but if you don't have these and you are 15 years of age you may apply for a moped license at secretary of state branch office.... BUT THIS IS IN Michigan i don't know about any other state.
