The Smith Act (1940) declared that it was criminal to advocate the overthrow of the government by force or violence. This Act was used to prosecute socialists in 1941, and later communist party members in the 1950s.

This law is still on the books, although many of the convictions under it were overturned. A key concern is its potential for inappropriate and unconstitutional application for political purposes.
