Is unlocking iPhones legal

An unlocked iphone has already been jailbroken. That is the first requirement to unlocking one, it has to be jailbroken first in order for Cydia to be added to the device. Without Cydia the device cannot be unlocked ergo it was already jailbroken before it was unlocked.
