Under the Homestead Act of 1862, a settler had to wait five years between filing an affidavit for a homestead claim and securing final title to the land. During this five-year period, the settler was required to reside on the land, cultivate it, and make improvements, such as building a dwelling and growing crops, to demonstrate their commitment to developing the property. After successfully completing these requirements, the settler could then apply for the final title to the land.
