Had He been beaten by the Jews than 39 lashes would have been the law, 40 having been accepted as a maximum humanly survivable, the Jews believed that they should hold back the 40th for fear of beating too many times. Jesus was not beaten in this manner though as He was flogged by the Romans who had no such law.
