Why has the tequila in the us 40 percent alcohol?

Because that's how the US legally defines spirits. If Mexico refused to raise the percentage, then the product wouldn't be a spirit in the eyes of the government, and therefore not allowed to be imported. Mexico decided that making a lot more money was a better choice than being traditionalists in this case, so they upped their percentage.
