If silence does not mean consent by what right does a government govern with less than 50 percent of the vote?

America was founded by minorities who were oppressed by the majority. This is the reason our government was guaranteed to be a Republic in form rather than a Democracy. Therefore, the representative process counts on accountability by the representative to their constituency and the Constitution in order to work properly and prevent misconstruction and abuse.
