Currently gay marriage would be considered a counterculture in most places. By definition a counterculture "is a subculture whose values and norms of behavior deviate from those of mainstream society, often in opposition to mainstream cultural mores" according to wikipedia" (lol I know right?) which is indicated by legislation either blatantly opposed to the concept or simply by it's omission.

In places where it is legal, again from Wikipedia "As of January 2013, nine states-Connecticut, Iowa, Maine,Maryland, Massachusetts, New Hampshire, New York, Vermont, and Washington-as well as the District of Columbia and two Native American tribes-have legalized same-sex marriage. In addition, Rhode Island recognizes same-sex marriages performed in other jurisdictions, and California, which briefly granted same-sex marriages in 2008, now recognizes them on a conditional basis." It would be considered a subculture as long as it was generally accepted among the populace.
