As a police officer, its not an easy of a question as some would think. Now generally as a rule of thumb, a vehicle that is stuck from the rear while stopped, or coming to a stop or what ever the case may be, it its the driver of the vehicle behind them that usually At Fault. It is that drivers responsibility to pay attention and to leave enough space between the vehicle in front of them and their vehicle to allow for a quick stop or swerve to avoid hitting the other vehicle.
Now besides the fact that there was a motorcycle involved there could be a number of things that could come into play. Was the Motorcycle moving or in a stopped position. Was all the lighting on the bike working, did this happen during a lane change. All questions that have to be asked before deciding who is at a fault in these types of accidents.
But to give you a ball park answer, Yes usually when there is a rear collision involving any vehicle, 9 times out of 10 is it the car behind them that is at fault.
