It vaires from state to state, however there is no clear cut answer whether is actually "illegal". In New York, Florida, Ohio, Kentucky, Pennsylvania, New Hampshire, Florida, and North Carolina it is "Illegal" to sell expired energy drinks due to the potentially damaging health effects.
