I suggest you retain a lawyer. This child was in your care and should have been wearing a seat belt. I'm afraid you will probably lose this case depending on what State you live in as there are seat belt laws in many of the States now. * Good Advice, seek legal counsel as soon as possible and DO NOT discuss the accident with anyone else, especially those others who are involved. The matter of whether or not the child was secured is troublesome but will only be relevant in the sense that the driver of the vehicle could be issued a ticket for failure to comply with existing safety laws. Even if the child had been properly restrained her parents would still have the legal option of filing a suit. Every driver can be held legally liable for injuries incurred by passengers regardless of the circumstances, even when the driver of said vehicle was not At Fault, the accident was unavoidable due to weather and/or road conditions and so forth.
