In the state of Florida if a person is found guilty of statue 794.011 he or she is guilty of a felony in the second degree which is punishable up to 15 years in prison. This true if the victim is at least 18 years of age or older. If the victim is younger the the charge may be enhanced to a felony of the 1st degree and if the victim is 12 or younger it can even be a capital felony which can have a term of life.
