An executive branch is the part of government that administers the laws, it enforces them, it makes them happen. It is one part of the three-part system of government theory developed by the French philosopher Charles-Louis Montesquieu. The other two are the legislative branch and the judicial branch. Republican theory requires divided government to ensure it cannot concentrate its power into a few hands and harm the liberty of the people. Under the Articles of Confederation, the divided government was the national Congress divided apart from the separate states. Under the Constitution as Madison envisioned it, the national government itself would be divided according to Montesquieu's principles: Article I. Legislature (Congress); Article II.
