Convictions can never be cleared from a DBS check (CRB checks were replaced by DBS checks in 2012). However, the conviction will be removed automatically if it becomes protected under the Rehabilitation of Offenders Act 1974.

A conviction will become protected if:

  • It is not on the list of offences that will never be filtered from a DBS check, and
  • the conviction did not result in a custodial sentence, and
  • it is your only conviction offence, and
  • it has been 11 years since you were convicted (5.5 years if you were under 18 at the time).
