Can a man demand a paternity test if there is already a different man listed on the birth certificate?

A person can demand anything he wants. It doesn't mean he'll get it.

If the man is sued for child support or if he brings an action for paternity/legitimation, he can ask the court the order that the parties undergo a DNA test. Most courts will order one when paternity is in question.
