Can a 12 year old kid drink a 5 hour energy shot?

The bottle specifically states, "do not take if pregnant, or under 12 years of age."

This can be construed two ways: You must be >12 to drink it, or you must be (couldn't find the character for it) 12 years or older. Since I can't really tell which it is, I leave you with the exact quote so you can figure it out for yourself.
