Why is my Black male molly is staying up near the surface in the corner of the tank next to the filter?

You probably need to do more regular water changes. The molly could well be sitting in the cleaner water flow comming from the filter. I recommend a 50% water change weekly as a basic requirement for keeping any kind of fish.
