The Chief Justice of the United States (Supreme Court) traditionally administers the Oath of Office to the President-elect on Inauguration Day, but neither the justices nor the Court participate in the election process.

In the case of Bush v. Gore, (2000), however, the Supreme Court's decision to stop Florida vote recounts on the somewhat dubious grounds that the recount violated Bush's 14th Amendment Equal Protection rights, resulted in the Court preempting the electorate in determining who won the popular vote.
